Welcome to the South Shore Chinese School (“SSCS”) website (this or our “Web site”). Please read this Terms of Use Notice (“Notice” or “Agreement”) carefully before using the Web site. By viewing or otherwise using this Web site, you agree you are at least 13 years old and agree to the SSCS Privacy Policy and to the terms and conditions in this Notice.

Site Contents and Ownership.

Unless otherwise expressly indicated, the information contained on this Web site, including but not limited to all images, illustrations, designs, photographs, video clips, text, icons, designs, written information, and other materials that appear on the Web site are copyrights, trademarks, trade dress or other intellectual property owned, controlled, or licensed (collectively, the “Contents”) by SSCS and are protected by U.S. and international copyright laws and conventions. The names and logos for SSCS are our content and shall not be used without prior consent or permission. The collection and compilation of the Contents are separately protected and copyrighted works owned exclusively by SSCS.

Your Use of the Site.

As a user of the Site, you have a revocable, nontransferable, nonexclusive license to access the Web site, view information contained on the Web site, and interact with the Web site solely for your own personal use. You may not use the Web site for any commercial purpose (other than for transacting business with SSCS) or for any unlawful or wrongful purpose. You agree not to rent, retransmit, disclose, publish, sell, assign, lease, sublicense, market or transfer the Web site or any portion of it (including the Content) or use it in any manner not expressly authorized by these Terms of Use. You further agree not to copy, reverse engineer, translate, port, modify or make derivative works of any portion of the Web site. By using the Web site and its features, you represent and warrant that (a) any information you submit to us is truthful and accurate; (b) you will maintain the accuracy of that information; and (c) your use of our Web site and its features does not violate any applicable law, rule or regulation. Any information that you provide to us will also be subject to our Privacy Notice.

SSCS may grant third parties the right to “link” to the Web site if the third party makes its request in writing. All third parties that have been granted rights to “link” to the Web site must use the URL linking mechanism supplied by SSCS. Any alteration, change, modification, adjustment or revision to a “link” must be approved by SSCS in writing prior to implementation.

Privacy Policy

SSCS believes strongly in protecting user privacy. Users of this Web site should refer to SSCS’ Privacy Policy, before providing any information.

Consent to Do Business Online

By accessing our Web site, registering with SSCS, or typing your name into any of our electronic forms and indicating your acceptance or submission of information by clicking a box, you consent to (a) SSCS communicating with you electronically; (b) receiving all applications, notices, disclosures and authorizations (collectively, “Records”) from us electronically; and (c) entering into agreements and transactions using electronic Records and signatures. Please note that federal law treats electronic signatures as having the same legal force and effect as if they were signed on paper by hand, and online contracts have the same legal force as signing an equivalent paper contract in ink. We will use electronic documents for all communications, agreements, disclosures, authorizations and other documents necessary to provide you with the Site. You agree to be responsible for keeping your own Records. You may print or download Records from the Site and keep them for your own reference. Agreements and transactions executed prior to this request will remain valid and enforceable.

Registration

The Site offers features that allow you to register for SSCS programs and services. For example, you may use our Site to enroll your child in one of our programs. If you register with us online, you will receive an email from SSCS confirming that you have completed the registration process. If you do not receive an email from us within a reasonable time period after you register, please contact us at info@sschineseschool.org. You are responsible for maintaining the confidentiality of your account and password, and you are responsible for all matters relating to your account and password.

Communications from SSCS

We may use your contact information to communicate with you about your use of our Web site. For example, we may send you service announcements or administrative communications by email, phone, or other means. We may send you marketing communications by email. You understand that you receive these communications as part of your use of the Web site. As part of our policy to provide you total privacy, we also provide you the option to opt out from receiving marketing communications from SSCS. However, you will not be able to opt out from receiving service announcements and administrative messages.

Proprietary Rights

SSCS reserves the right to change any and all Content contained on this Web site at any time without notice. Reference to any products, services, processes, or other information, by trade name, trademark, manufacturer, and supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by SSCS.

Limitation of Liability

To the maximum extent allowed by applicable law, in no event shall SSCS or any of their officers, directors, or staff be liable for any direct, special, incidental, indirect or consequential damages, or any other damages of any kind, including, but not limited to, loss of use, loss of profits or loss of data, whether in an action in contract, tort (including, but not limited to, negligence), or otherwise, arising out of or in any way connected with the use of, or inability to use, this Web site or content contained on, or accessed through, this Web site, even if SSCS has been advised of the possibility of such damages.

SSCS is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or redemption to be received by SSCS on account of technical problems or traffic congestion online or on this Web site or at any web site, or any combination thereof including any injury or damage to entrant’s or any other person’s computer related to or resulting from downloading any materials from this Web site. If, for any reason, this Web site is not capable of running online as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of SSCS that threatens or corrupts or adversely affects the administration, security, fairness, integrity or proper conduct of this Web site, SSCS reserves the right, in its sole discretion, to cancel, terminate or suspend the use of this Web site.

CAUTION: ANY ATTEMPT BY YOU TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS WEB SITE MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SSCS WILL TERMINATE THE YOUR USE OF THIS WEB SITE AND RESERVES THE RIGHT TO SEEK DAMAGES FROM YOU TO THE FULLEST EXTENT PERMITTED BY LAW.

Indemnification

You agree to defend, indemnify and hold harmless SSCS, and all of their officers, directors, and staff from and against any and all claims, damages, costs and expenses, including attorneys’ fees, arising from or related to your use of this Web site.

Applicable Law These terms and conditions shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its choice of law principles to the contrary. You agree any action at law or in equity arising out of or relating to these terms and conditions shall be filed only in the state and federal courts residing in Boston, Massachusetts, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action, or proceeding arising out of this Notice.

Severability

If any provision of this Notice shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this Notice and shall not affect the validity and enforceability of any remaining provisions.

Confidentiality

All information supplied by you to SSCS during the completion of the registration is subject to the Privacy Policy.
